It’s been almost a decade since Te Ātiawa o Te Waka-a-Māui Trust was established on June 4, 2013, as the Mandated Iwi Organisation and Post-Settlement Governance Entity for Te Ātiawa o Te Waka-a-Māui.

Ahead of the 10-year anniversary, Trustees have agreed to review our Deed of Trust, the legal document that established the Trust and empowers it to govern and manage the iwi’s pre- and post-settlement assets.

We can’t do this on our own, and the feedback of our uri into this process is vital.

We are holding a series of hui throughout the motu this month, starting next week in Taranaki, and welcome all registered members to come along and share your ideas.

The hui will cover both the Trust Deed Review and E Titia, the Trust’s Strategic Plan, with lots of time for feedback and pātai.

Dates and locations as well as a Q&A on both the Deed Review and the Strategic Plan are below.

He aha te Trust Deed? What is the Trust Deed?

Our Deed of Trust is the legal document that established Te Ātiawa o Te Waka-a-Māui Trust as the Mandated Iwi Organisation and Post-Settlement Governance Entity for Te Ātiawa o Te Waka-a-Māui. It was signed on June 4, 2013. This followed our Deed of Settlement with the Crown on December 21, 2012. The Deed empowers the Trust to govern and manage the iwi’s pre- and post-settlement assets on behalf of its members.

What does the Deed say?

The Deed sets out a variety of things that underpin the operations of the Trust. These include:

• • Administering the assets held collectively for Te Ātiawa o te Waka a Maui. 
  • The Te Ātiawa Group structure.
  • The registration process as uri of Te Ātiawa o te Waka a Maui and a beneficial member of the Trust.
  • How beneficial members are represented on the Trust.
  • How the Trust representatives are chosen.
  • What the representatives’ roles and duties are.
  • How the Trust is held accountable for carrying out its roles and duties.

Why review it now?

After almost 10 years of operation as a Post-Settlement Governance Entity (PSGE), Trustees think it’s timely to review the Deed, particularly the arrangements relating to the election of Trustees and some other aspects tied to better representation.

There are also opportunities to improve the layout and drafting of the Trust Deed.

Are here any restrictions and constraints associated with the review?

Yes, there are some parts of the Trust Deed which cannot be amended or removed through any review. These are set out in Clause 11.1 and 11.2 of the Deed. 

What is the review process?

These are the sort of things we want to hear from you about.

• What do you think about the current structure and representation model? Is the current number of Trustees (8) right? Too few? Too many?
• Election procedures and policies. What can we do to boost numbers voting?
• If you had an opportunity to change the representation model, what would it look like? How do we balance representation versus skills and experience?
• Is the Group structure working in your view, including between the Trust and its subsidiary entities?
• Day-to-day operations. What is it you want to see from the Trust, that you are not seeing at the moment? 
• Are there some better or alternative things we could be doing with our time and resources?
• Is it satisfactory the way that the Trust are governing and managing your assets and resources? Do you have any ideas or suggestions for improvements?
• Communications and engagement. Do you want less or more? How about for members who live outside of the rohe?

 What is the Strategic Plan all about?

E Titia 2018-2023 sets out the Vision, Purpose, Values and Goals of the Trust. We are now working on what the next phase of our Strategic Plan will be and particularly what you think our focus should be.
